REMEDY: IF YOU ARE DISSATISFIED WITH  PurposeBuilt.org’s SITE, OR ANY PORTION THEREOF, YOUR EXCLUSIVE REMEDY SHALL BE TO CEASE USING PurposeBuilt.org’s SITE. .

User Code of Content; Acceptable Use.

PurposeBuilt.org may contain e-mail services, bulletin board services, chat areas, news groups, forums, communities, photo albums, and/or other message or communication facilities designed to enable you to communicate with others (collectively, "Communication Services"). You agree to use the Communication Services only to post, send and receive messages and material that are proper and, when applicable, related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

·         Upload, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consents to do the same.

·         Use any material or information, including images or photographs, which is made available through PurposeBuilt.org in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party.

·         Upload files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another.

·         Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages.

·         Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner.

·         Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.

·         Restrict or inhibit any other user from using and enjoying the Communication Services.

·         Violate any code of conduct or other guidelines that may be applicable for any particular Communication Service.

·         Harvest or otherwise collect information about others, including e-mail addresses.

·         Violate any applicable laws or regulations.

·         Create a false identity for the purpose of misleading others.

PurposeBuilt.org has no obligation to monitor the Communication Services. However, PurposeBuilt.org reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. PurposeBuilt.org reserves the right to terminate your access to any or all of the Communication Services at any time, without notice, for any reason whatsoever. PurposeBuilt.org reserves the right at all times to disclose any information as PurposeBuilt.org deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in PurposeBuilt.org’s sole discretion.

PurposeBuilt.org does not control or endorse the content, messages or information found in any Communication Service and, therefore, PurposeBuilt.org specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service.

No compensation will be paid with respect to the use of your Submission, as provided herein. PurposeBuilt.org is under no obligation to post or use any Submission you may provide and PurposeBuilt.org may remove any Submission at any time in its sole discretion.

By Posting a Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in these Terms of Use including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.

Governing Law and Venue.

This Agreement shall be interpreted, construed and governed by the laws of the State of Missouri, USA, without reference to its laws relating to conflicts of law and not including the provisions of the 1980 United Nations Convention on Contracts for the International Sale of Goods. Venue for all disputes arising under this Agreement shall lie exclusively in the Superior Courts of the State of Missouri (as permitted by law) and each party agrees not to contest the personal jurisdiction of these courts. Notwithstanding the foregoing, however, PurposeBuilt.org shall have the right to commence and prosecute any legal or equitable action or proceeding before any non-U.S. court of competent jurisdiction to obtain injunctive or other relief in the event that, in the opinion of PurposeBuilt.org, such action is necessary or desirable.

Enforcement.

Should any clause of these Terms of Use be found unenforceable, wherever possible this will not affect any other clause and each will remain in full force and effect. PurposeBuilt.org failure to expressly enforce any provision of these Terms of Use does not waive its rights to enforce that or any other provision.

Modification/Integration.

We reserve the right to change these Terms of Use, and other information available on PurposeBuilt.org, without notice. These Terms of Use set out the entire agreement between PurposeBuilt.org and you relating to your use of PurposeBuilt.org.
